Agreement to Terms

By accessing or using the Demarest Nature Center website ("Site"), participating in our programs, or visiting our preserve, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Site or services.

Use of Website

Permitted Use

You may use our Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local laws
• Transmit any harmful code, viruses, or malicious software
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Site or servers connected to the Site

Program Registration and Participation

Registration

By registering for programs or events, you agree to:

• Provide accurate and complete information
• Pay all applicable fees by the specified deadlines
• Follow all program rules and instructor guidance
• Notify us of any changes to your registration information

Cancellation and Refund Policy

• Participant Cancellations: Cancellations made more than 7 days before a program may receive a partial refund minus an administrative fee. Cancellations made within 7 days are non-refundable
• Program Cancellations: We reserve the right to cancel programs due to insufficient enrollment, weather, or other circumstances. Full refunds will be provided for programs cancelled by DNC
• No-Shows: Failure to attend a registered program without prior notice is non-refundable

Code of Conduct

All program participants must:

• Treat staff, volunteers, and other participants with respect
• Follow safety guidelines and instructions
• Respect the natural environment and wildlife
• Refrain from disruptive or inappropriate behavior

We reserve the right to remove participants who violate our code of conduct without refund.

Preserve and Facility Use

Visitor Rules

When visiting Demarest Nature Center, you agree to:

• Stay on designated trails
• Carry out all trash and recyclables
• Keep pets leashed at all times
• Not disturb or remove plants, animals, or natural objects
• Not smoke or use tobacco products on the grounds
• Follow posted rules and regulations

Hours and Access

Trails are open during daylight hours. We reserve the right to close trails or facilities for safety, maintenance, or special events. Trespassing outside of designated hours is prohibited.

Donations and Payments

Donations

All donations to Demarest Nature Center are final and non-refundable. As a 501(c)(3) nonprofit organization, donations may be tax-deductible to the extent allowed by law. You are responsible for determining the tax deductibility of your contribution.

Membership

Memberships are non-transferable and non-refundable. Membership benefits are subject to change. We reserve the right to terminate memberships for violation of our terms or code of conduct.

Payment Processing

Payments are processed securely through third-party payment processors. We do not store credit card information on our servers. By providing payment information, you authorize us to charge the specified amount.

Liability and Assumption of Risk

Assumption of Risk

Participation in outdoor activities involves inherent risks. By visiting our preserve or participating in programs, you acknowledge and assume these risks, including but not limited to:

• Uneven terrain, slippery conditions, and natural hazards
• Weather-related risks
• Wildlife encounters
• Insect bites and plant allergies
• Physical exertion and related injuries

Limitation of Liability

To the fullest extent permitted by law, Demarest Nature Center, its board members, volunteers, and staff shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

• Use of our Site or services
• Participation in programs or events
• Visits to our preserve
• Errors or omissions in content
• Interruption of service

Indemnification

You agree to indemnify and hold harmless Demarest Nature Center from any claims, damages, losses, or expenses arising from your use of our Site, violation of these Terms, or violation of any rights of another party.

Medical and Emergency Information

By participating in programs, you represent that you are in good health and capable of participation. You agree to inform staff of any medical conditions, allergies, or medications that may be relevant to participation.

In case of medical emergency, we may seek emergency medical treatment on your behalf. You agree to be financially responsible for any medical costs incurred.

Photography and Media Release

By participating in programs or visiting during events, you grant Demarest Nature Center permission to use photographs, video recordings, or other media in which you appear for promotional and educational purposes without compensation. If you do not wish to be photographed or recorded, please inform staff.

Privacy

Your use of our Site and services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
